VERY IMPORTANT! READ CAREFULLY BEFORE YOU ATTEMPT TO BID. ONCE YOU BID, YOU WILL BE BOUND LEGALLY BY THE FOLLOWING TERMS AND RULES THAT ARE STATED HERE. BY REGISTERING FOR OUR AUCTIONS, IT IS CONSIDERED A CONTRACT AND THE FOLLOWING TERMS APPLY. TERMS AND CONDITIONS CAN CHANGE DEPENDING ON THE CIRCUMSTANCES OF EACH SALE. IT IS VERY IMPORTANT TO REVIEW THE TERMS BEFORE PARTICIPATING IN ANY AUCTION! TERMS FOR EACH AUCTION CAN BE FOUND IN LOT #0.

  • All items are sold “AS IS, WHERE IS, with NO WARRANTY expressed or implied.

  • Keep in mind that most of the items we sell are used and may have scratches, dents, dings, holes, funky odors, etc. 

  • Descriptions are believed to be accurate but not guaranteed. Any mention of an item’s condition is not an official grading of the item’s condition. When you are not certain of the condition or wear of an item, please bid accordingly. 

  • Enlisted Auctions strongly suggests bidders to attend the scheduled preview to gauge the condition of each piece and to gain perspective on the size or number of items in each lot.  

  • Onsite or wholesale auctions may have items in the attic, basement, barn, dark alley, scary dungeon rooms and other places that your spouse may be hesitant to enter. Please consider attending the preview to help understand any complications in removing your treasure.

  • We are not as mean as we sound, but please do your best to play by the rules. It is the only way we can serve you and the rest of our customers to the best of our ability. 

Bidding

  • You must be registered to place a bid on an item. 

  • By placing a bid, you agree to all the terms and conditions that apply to that auction. Before you bid, please take a few seconds and look at the information provided in Lot # 0. This will have the location, date/times for the preview and pickup, and other pertinent information. 

  • All bids are final. The bidder does not have the ability to remove a bid once it has been placed.

  • You are bidding on the item in the photograph. Occasionally, the wrong description is displayed. Always look at the photo! Please contact Enlisted Auctions if you find an error in the catalog and we can make the correction as needed.

Payment

  • A 10% buyer’s premium (plus state and local tax) will be added to each purchase. 

  • If you are tax-exempt, you will need to provide a copy of your tax-exemption form.

  • Payment can be made with a credit or debit card using the online payment link found in the email notification received upon winning. 

  • Payment will also be accepted at the pickup location by cash, approved check, and/or credit/debit card.

  • Payment must be made within 24 hours of the auction ending. Failure to pay will result in revocation of bidding privileges. A $25.00 reactivation fee of a suspended account will be required. Reactivation will be determined on a case-by-case review. 

  • Registration is a legal and binding agreement to accept responsibility for payment. Deviation from this agreement can result in legal action and fees.

Preview

  • Preview is an “open house” to allow our customers to inspect the items before they bid or buy. Items are identified by the lot number affixed to the item. 

  • Preview is highly recommended so you can make your own determination of quality, size, condition, weight, item location, and all the other variables that are difficult to convey in a photo.

  • Unless specifically addressed in the description, it is safe to assume the items have NOT been tested. You are welcome and encouraged to test any item during the preview times listed.

Pickup

  • Bidders are responsible for their own removal. Removal shall be at the expense, liability, and risk of the purchaser. 

  • Purchases will be released upon presentation of a paid email receipt. Please ensure that movers or anyone picking up items on your behalf have your paid receipt at the pickup location. No items will be released without a paid email receipt.

  • All items must be removed during the schedule pickup time(s). Any items not removed during the pickup times will considered abandoned and become the property of Enlisted Auctions (unless other arrangements have been made). 

  • Please bring plenty of help and proper equipment needed to remove your items. Auction staff is not available to assist with loading. Do not bring a Civic to take home a bedroom suite, please.

  • If you are unable to make the pickup time due to a flat tire, mean boss, traffic jam, car fire, sudden illness, deceased relative, or any other catastrophic event, please contact Enlisted Auctions at 540-337-3446 or info@enlistedauctions.com. We can make special arrangements (for a fee) in most cases. Items MUST be paid in full to qualify for storage.

  • Items not claimed in our gallery auctions by the end of the scheduled pickup times will be assessed a $5.00 alternative pick-up fee. Furniture and any large items (items that do not fit into a box) will be subject to an additional $20.00 storage fee if the items are not picked by closing time on Friday. After one week, the items will be considered abandoned and/or forfeited by the buyer. For onsite auctions, please call or email. Charges vary depending on the resources required for us to store your items

  • Enlisted Auctions can provide delivery to a storage facility in Stuarts Draft if needed. Please contact the office for rates and more details. 

Shipping

  • Shipping is available on most items. Please contact the office if you would like to have your items shipped. A processing charge and shipping costs will be added to your invoice and must be paid prior to shipping.

Firearm Sales

  • We are a licensed firearms dealer. 

  • Bidder must be eligible to purchase a firearm under local, State, and Federal guidelines. 

  • Shipping is provided to continental US FFL holders for most gun purchases. Additional charges will apply. See details in the firearms auction for shipping rates. 

Staggered Closing

  • The online auction closes three items per minute (may differ on each auction). Please watch the countdown timer on each lot. This feature will close the bidding in intervals. This feature works great with the auto-extend feature to closely emulate a ‘live’ auction.

Soft Closing (auto-extend)

  • The closing time of an item is automatically extended an additional two minutes whenever a bid is placed within the last two minutes of the item’s closing time, thus allowing a backup bidder the opportunity to raise their bid. For example, if an item is set to close at 8:05 pm, and a bidder places a bid on the item at 8:04 pm, the item’s closing time will be extended to 8:06 pm. If another bid is placed at 8:05 pm, the item’s closing time will be extended to 8:07 pm, and so on until no other bids are received.

Bid Notification

  • If you have been outbid, you will be notified by email or phone notification (app users) ONLY UNTIL the last two minutes of the item’s scheduled closing time. 

  • To quickly review your bids and see if you have won, you can utilize the “My Items” feature. Items that you have been outbid on will be clearly marked.

Winning Bidder Notification

  • You will be contacted by email or phone notification (app users) for any items you have won. 

  • If you feel you have won an item and have not received an email you must notify us by email no later than 9:00 am the next day. If you do not receive an emailed invoice then you did not win any items at the online auction.

  • In the event an item is missing from your lot, the buyer must notify our onsite staff before leaving the auction premises. After 24 hours, the Auctioneer and buyer agrees that no adjustment or refund will be made.

Images Don't Guarantee Items

  • For demonstration purposes various equipment may be joined. Do not assume a lot consists of more than one item simply because they are connected or pictured together. Please inspect the lot numbers and read the descriptions.

 

Abandoned Items/Delinquent Accounts

  • The Auctioneer will have the option of reselling, removing, storing or abandoning, purchased items not paid for and/or removed within the specified timeframe. 

  • The buyer agrees to pay all deficiencies, legal, collection, transportation and storage expenses associated with delinquent accounts or abandoned items.

Choose Wisely

  • We want everyone to get a good deal and most will. However, when you bid on the wrong item or decide an item is not suited for your intended use, our clients are not willing to assume the cost of your mistakes. When in doubt about condition, completeness or suitability for intended use, please bid accordingly.

  • The auctioneer reserves the right to add or remove items from the auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend or reschedule an individual item and or auction event, make changes to the auction closing times or inspection or removal times. 

  • Any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, and judgments upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Venue will be Augusta County, Virginia.

Liability

  • Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price.

Limitations

  • The above-stated Conditions of Sale cannot be altered except in writing by The Auctioneer.

Privacy

  • We respect your privacy and that of the other bidders. We will not release your information to anyone without your permission.
